Tour Waiver

A Man & His Sandwich LLC tours Waiver & Release of Claims I hereby waive any and all claims I may have now and in the future, and release from all liability, claims, suits and damages, A Man and His Sandwich LLC, its shareholders, board members, affiliates, officers, agents, representatives, employees or tour guides for any personal injury, death, property damage, or loss sustained by me as a result of my participation in this tour with A Man and His Sandwich LLC due to any cause whatsoever, including without limitation, negligence on the part of A Man and His Sandwich LLC, its staff or other participants, or third parties or for death or injury as a result of war, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action. I am aware that the tour, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared or fit and weather extremes subject due to sudden and unexpected changes. I accept all the inherent risks of the proposed tour and the possibility of personal injury, death or property damage or loss resulting therefrom. I acknowledge that the enjoyment and excitement of the proposed form of tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree that if I suffer injury or illness A Man and His Sandwich LLC or its staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance shall result in my removal from the tour. A Man and His Sandwich LLC is not a licensed food handler nor any type of guarantor of food safety. While every effort is made to accommodate special dietary needs by addressing customer concerns with the food vendors, decisions affecting food safety and customer health are the responsibility of the customer who alone assumes the inherent risks thereof. A Man and His Sandwich LLC shall assume no liability for any matters related to food safety. I fully comprehend and accept all of the risks associated with my participation in the food and/or drink tours offered by A Man and His Sandwich LLC including, without limitation, injury or death resulting from exposure to unfavorable weather conditions, food sickness, allergic reactions, choking, and injuries arising from accidents or mishaps, other participants, motor vehicles, and pedestrians. I understand and accept that the food and/or drink tours offered by A Man and His Sandwich LLC take place in public venues under conditions largely beyond the Company’s control. In entering this Waiver and Release, I am not relying on any oral, written or visual representations or statements by A Man and His Sandwich LLC or its staff or any other inducement or coercion to go on a tour. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this tour and Waiver and Release prior to going on the tour and agree that this Waiver and Release will be binding upon my heirs, next of kin, executors, administrators and successors. As a participant on an A Man and His Sandwich LLC tour, I knowingly and willfully accept these risks and take complete and total responsibility for my behavior, well-being and health during the tour. I agree to hold neither A Man and His Sandwich LLC, nor its Staff nor the food cart owners, market vendors, or retail shops liable in any way should any harm come to me. I agree to grant the sponsors of this tour to a worldwide, royalty-free license to use my photographic, video, or digital likeness for promotional, educational, and/or commercial purposes. I have read and understand everything written above and I consent to this agreement. I further affirm that I am eighteen (18) years of age or older. If I am under eighteen (18) years of age, the person consenting on my behalf is a parent or other responsible adult. Since the early days of immigration at Ellis Island, New York has become a common ground for people of all nationalities. Each person brought a unique style of delicious food to the city. Kitchens serving authentic food were a way to reconnect with the culture deeply rooted in these future American citizens. OUR MISSION

Well for starters, it’s a whole lot more than just eating sandwiches. Think amazing sammies, great laughs, cold drinks, and a surprisingly high amount of history and storytelling. What started as a crazy idea for ‘a bar crawl for sandwiches’ in 2017, quickly became a deliciously fun walking tour that values having a laugh as much as it does feasting on great sandwiches. Each tour will take you to 3 hidden gem locations to enjoy delicious sandwiches made by real New Yorkers. As you eat, you’ll learn about the history of the dish you are enjoying, the people who made it, and the neighborhood you’re eating in. Our ‘signature move’ though is to blow your mind while you eat with a fun debate about whether or not a hotdog is a sandwich. Or a burger. Or a burrito… You’ll never believe how strong your opinions are about sandwiches until we try to convince you that a lasagna is one. What a terrific experience! I have been on food tours before, but Ben made this experience a stand-out one. First he asked us what kind of sandwiches we like, and then he made a point of taking us to places that echoed our preferences. I say echo because each sandwich place provided a unique spin on our preferences, whether it was a unique sauce, or combination of ingredients. Second, he knew the background of the shop owner - their cooking experience, how they wound up in NYC and how long they'd been in business. It made it far more interesting than just eating a sandwich. He was always able to find a place to sit down, he engaged us in a lively philosophical debate about "what is a sandwich?" and "does a hot dog count as a sandwich?". He shared some personal information when asked, but didn't make the tour about himself. He made it a fun, enlightening and satisfying experience, and I would highly recommend him to anyone. Ben is really passionate about sandwiches, it's not made up, and he actually really studied what could or could not be called a sandwich. Ben was an incredible host and this experience was so great for my parents and I! Not only did Ben take us to 3 wonderful, local, IYKYK spots, he also explained the history and significance of each establishment and why their sandwiches are so special. Each sandwich was DELICIOUS, and he was a great person to chat with at each stop and while in transit. He encouraged debate ("is a hotdog a sandwich?") throughout the tour which ended up being such a funny and challenging part of the experience (in a good way). Ben's sandwich tour was amazing! I went for an Airbnb Host outing. As a fellow, rather new food tour guide, I really enjoyed the experience and recommend his Sandwich food tours to others! The thing I liked most about it is that he made the experience interactive and philosophical. Prodding us with questions like 'Does this wrap qualify as a sandwich?' Gives me things to think about for a while. We got to sample 3 kinds of sandwiches from different shops with their own unique stories, and a different aspect of sandwich-ology questions. I like that he was accommodating and double checking if I wanted to eat cheese because I'm lactose intolerant. I probably shouldn't have but I had Lactaid and the sandwiches we had without cheese would of felt like a crime. There were 3 sandwiches and the one that stood out to me was the pho wrap. It's been on my list for a while, and it was a happy surprise to have it. It was my highlight, also one of the bars we ate at had a killer root beer.

Ben makes this a fun experience from beginning to end. The group is encouraged to interact and ask questions and share opinions, so the sandwiches themselves are almost secondary to the socializing going on amongst the group and with Ben - who has a lot of great things to share and debate about what makes a sandwich a sandwich. Lastly, the sandwiches are tasty, multi-culti, unique New York treats, and the spaces where we ate and drank were really special. And…all food restrictions are taken into consideration. When I say you will never, EVER meet a person who loves sandwiches more than Ben, I mean it.
